Article 1 In order to strengthen the management of urban appearance and environmental hygiene and create a clean, orderly and civilized urban environment, these Provisions are formulated in accordance with the Regulations on Urban Appearance and Environmental Hygiene Administration of the State Council, the Measures for the Administration of Urban Appearance and Environmental Hygiene of Fujian Province and the relevant laws and regulations, and in light of the actual conditions of this Municipality.

Article 2 These Provisions shall apply to the urban built-up areas within the administrative areas of this Municipality and the areas designated by the people's governments of counties (cities) to implement urbanization management.

The specific scope of urban built-up areas and areas under the management of urbanization shall be determined by the people's governments of cities, counties (cities) and announced to the public.

Article 3 The term "three guarantees in front of the door" as mentioned in these Provisions refers to the person in charge fulfilling the corresponding responsibility requirements for the appearance and appearance of the city, environmental sanitation, greening and brightening within the scope of the responsible area.

Article 4 The people's governments at all levels of this Municipality shall strengthen their leadership in the management of the "front three guarantees" responsible areas for city appearance and environmental hygiene within their respective jurisdictions, establish a working coordination mechanism, guarantee the required funds, improve the construction of relevant facilities, and improve the level of public services for city appearance and environmental hygiene.

Article 5 The administrative law enforcement department of municipal urban management is the competent department in charge of the management of the municipal "front three guarantees" responsibility area for city appearance and environmental hygiene, and is responsible for the organization, guidance, supervision and inspection of the management of the municipal responsibility area.

Municipal housing, urban and rural construction, planning, environmental protection, industry and commerce, food and drug supervision, public security, finance, health and family planning, education, cultural, radio and television news and publishing departments shall, in accordance with their respective responsibilities, do a good job in the implementation of the management of the "front three guarantees" responsibility area for urban appearance and environmental hygiene.

The competent department of City Administration designated by the people's government of a county (city or district) shall be responsible for the organization, implementation, supervision and inspection of the management of the "front three guarantees" responsible area for city appearance and environmental sanitation within its jurisdiction.

Subdistrict offices and town people's governments are responsible for the specific implementation and daily supervision of the management of the "front three guarantees" responsibility areas for the city appearance and environmental hygiene within their respective jurisdictions.

Village (residential) committees help to do a good job of publicity and mobilization and routine inspection of the management of the "front three guarantees" responsibility areas for urban appearance and environmental hygiene.

Article 6 The scope of "three guarantees in front of doors" for the city's appearance and environmental hygiene shall be the general head of the building along the street horizontally, the building (structure) along the wall foundation of the street to the stone along the pedestrian road vertically, and the facade shall be the facade of the building (structure) along the street.

Where the scope of the area of responsibility is disputed, the people's government of the sub-district offices and towns shall organize the relevant responsible persons to decide through consultation; if the consultation fails, the competent department of City Administration determined by the people's government of the county (city or district) shall jointly determine and inform the relevant responsible persons in writing.

Seventh the persons responsible for the appearance of the city and the sanitation of the "three packages in front of the city" shall be determined according to the following provisions:

(1) In residential areas and office buildings where property management is practiced, the property service enterprise shall be the responsible person; in residential areas and office buildings where property management is not practiced, where an owner committee has been established, the owner committee shall be the responsible person; in the absence of an owner committee, the village (residential) Committee of the locality shall be responsible for the matter;

(2) In the construction site of a construction project, the construction unit is the person responsible; in the case of land used for construction projects that have not yet begun construction or land collected and stored, the construction unit or the land and resources department shall be the person responsible;

(3) In public places such as culture, sports, parks, squares, public green spaces, stations and wharfs, the management and administration units shall be responsible persons;

(4) In stores, supermarkets, fairs, specialized markets, hotels and restaurants, the business and management units shall be responsible persons;

(five) the administrative region of the organs, organizations and enterprises and institutions, and the unit is the responsible person;

(six) rivers, lakes, ponds and other waters and shoreline, the management unit is the responsible person;

(seven) the parking and temporary parking sections are the persons responsible for the operation and management.

Where there are business units among the responsible persons, the business unit shall be the responsible person; if there are no business units, the management unit shall be the responsible person.

Where the person in charge is in dispute, the competent department of City Administration determined by the people's government of the county (city, district) shall, together with the sub-district offices and the people's government of the town, jointly determine and notify the person in charge in writing in accordance with the principle of "who uses and who is responsible".

Article 8 The person in charge shall sign the "three guarantees in front of the door" of the city appearance and environmental sanitation with the local sub-district office and the people's government of the town, and mark it in a conspicuous position.

If the responsible person refuses to sign the responsibility letter, the local sub-district office or town people's government may issue the responsibility letter to the responsible person.

The text format of the letter of responsibility shall be formulated by the administrative law enforcement department of the municipal administration.

Article 9 The person responsible for the "three guarantees in front of the door" of the city's appearance and environmental hygiene shall keep the city's appearance and appearance in the responsible area clean and tidy and fulfill the following requirements:

(1) it is forbidden to run beyond the doors and windows and the outer walls in violation of regulations.

(two) no violation, such as building, placing, hanging, posting, scribbling, portrayal, etc.;

(three) outdoor advertising and signboards are in line with the national standard of city appearance.

(four) purification and emission of cooking fumes in catering industry conform to the standards for cooking fume emission in the catering industry.

(five) motor vehicles are orderly parked at the parking points designated by the traffic management departments of public security organs.

Article 10 The person responsible for the "three guarantees in front of the door" of the city's appearance and environmental hygiene shall keep the environment in the responsible area clean and tidy, and fulfill the following responsibilities:

(1) domestic waste bags are placed at regular intervals;

(two) it is not allowed to dump, scatter or pile up domestic refuse at will.

Article 11 The person responsible for the "three guarantees in front of the door" of the city's appearance and environmental hygiene shall keep the greening and brightening in the responsible area intact and fulfill the following responsibilities:

(1) it is forbidden to occupy green space, destroy seedlings and pick flowers and fruits in violation of regulations.

(two) trees must not be tied up or tied up.

(3) There is no defect or breakage in the lighting facilities for night scenery lights and advertising signs set up or used for management.

Article 12 The responsible person shall promptly dissuade and stop other persons within the responsible area from violating the regulations governing the management of the "three guarantees in front of the door" responsible area for city appearance and environmental hygiene; if dissuasion or dissuasion is invalid, he shall promptly report to the competent department of City Administration determined by the people's government of the County (city or district).

Article 13 Any unit or individual shall have the right to dissuade and may lodge a complaint or report to the administrative law enforcement department of city administration and the competent department of city administration as determined by the people's government of the county (city or district).

The competent departments of Urban Administration determined by the people's governments of counties (cities and districts) shall establish and improve the acceptance system of complaints, announce the complaints and reports telephone and public micro-mail platform to the public, and check and handle the complaints and reports of the public in a timely manner.

The news media are encouraged to expose the acts that damage the appearance of the city and the environment.

Article 14 The administrative law enforcement departments of municipal urban administration and the competent departments of Urban Administration determined by the people's governments of counties (cities and districts) shall, through the public media such as radio, television, newspapers and periodicals, strengthen the publicity and education work in the management of the "three front door" responsibility areas for urban appearance and environmental sanitation, so as to enhance citizens'participation in the management of the city appearance and environmental sanitation. Management consciousness.

Article 15 The competent departments for Urban Administration determined by the people's governments of counties (cities and districts) shall strengthen supervision and inspection over the implementation of the management of the "three front door guarantees" for urban appearance and environmental hygiene by the responsible persons, and promptly deal with acts that violate the regulations on the management of the "three front door guarantees" for urban appearance and environmental hygiene.

The competent departments of Urban Administration determined by the people's governments of counties (cities and districts) shall, in conjunction with the sub-district offices and town people's governments, supervise and inspect quarterly the management of the responsible persons in implementing the "three guarantees in front of the door" responsibility areas for urban appearance and environmental hygiene.

Article 16 The people's governments of cities and counties (cities and districts) shall establish an appraisal system for the implementation of the management of the "front three guarantees" responsibility zones for urban appearance and environmental sanitation. The results of the appraisal shall be included in the performance appraisal and awards shall be given to the units and individuals who have made outstanding achievements in implementing the "front three guarantees" responsibility zones for urban appearance and environmental sanitation.

Article 17 Government organs, organizations, enterprises and institutions shall take the management of the "front three guarantees" responsibility areas for urban appearance and environmental hygiene as an important assessment content for the establishment of civilized units.

Article 18 If a unit or individual commits one of the following acts within the area of responsibility, the municipal administrative law enforcement department and the competent department of Urban Administration determined by the people's government of the county (city or district) shall order it to make corrections and impose a fine in accordance with the following provisions:

(1) in violation of the regulations to operate beyond the doors and windows and the outer walls, a fine of more than five hundred yuan and two thousand yuan shall be imposed.

(2) Whoever, in violation of the provisions, commits acts of erecting, placing, hanging, posting, painting or portraying shall be fined not less than 200 yuan but not more than 1,000 yuan;

(3) If the outdoor advertisements and signs do not conform to the national standards for urban appearance, the offender shall be fined not less than 500 yuan but not more than 2,000 yuan.

(4) Whoever dumps, throws or heaps up domestic refuse at will shall be fined not less than 5,000 yuan but not more than 50,000 yuan by the unit; and fined not more than 200 yuan by the individual;

(5) Whoever, in violation of the regulations, occupies green space, damages seedlings or picks flowers and fruits shall be fined not less than 50 yuan but not more than 500 yuan;

(six) a fine of more than fifty yuan and five hundred yuan shall be imposed by means of tree stringing and tying articles.

(7) Those who set up or use managed night lights and advertising signs to illuminate the defects or fail to repair them in time shall be fined not less than 500 yuan but not more than 2,000 yuan.

Article 19 If the purification and discharge of cooking fumes by units or individuals within the responsible areas do not conform to the national standards for cooking fumes discharge, the administrative law enforcement department of the municipal or district urban administration or the competent environmental protection department of the county (city) people's government shall impose penalties according to law.

Article 20 If a unit or individual fails to park motor vehicles in an orderly manner at a parking place designated by the traffic administrative department of a public security organ within the area of responsibility, the administrative law enforcement department of the city or district administration or the traffic administrative department of a public security organ at a city or county (city or district) shall impose penalties according to law.

Article 21 Public security organs shall, in accordance with the Law of the People's Republic of China on Administrative Penalties for Public Security, punish those who obstruct the relevant departments and their staff from performing their duties according to law; if a crime is constituted, criminal responsibility shall be investigated according to law.

Article 22 If the administrative personnel of the relevant departments of city, County (city, district) City Administration and the people's governments of sub-district offices and towns fail to perform their statutory duties, neglect their duties, abuse their powers and engage in malpractices for personal gain, the unit to which they belong or the competent department at a higher level or the supervisory organ shall punish them; if the case constitutes a crime, criminal responsibility shall be investigated according to law.
